Terms of Service
These Terms of Service (“Terms”) govern your use of the mobile application Echo and related services (collectively, the “Services”) operated by Karuwa Apps Pvt. Ltd., doing business as Echo (“we,” “us,” or “our”). By creating an account, downloading Echo, or using the Services, you agree to these Terms and our Privacy Policy.
If you do not agree, do not use the Services.
1. Eligibility
Echo is listed as 17+ on the Apple App Store. You represent that you are at least 17 years old (or the minimum age shown for Echo in the app store in your region, if higher) and have the legal capacity to agree to these Terms where you live. The Services are not directed at children under 13; see our Privacy Policy.
2. The Services; wellness focus; not emergency care
Echo is a health and wellness app (including journaling, streak-style tracking, mindfulness-style prompts, optional AI-assisted chat or voice, reminders, and related tools) aimed at routines around breakups, relationships, and no-contact goals.
Important. Echo is for everyday wellness and self-care routines. It is not a substitute for individualized professional advice or regulated professional services where those apply in your region, and nothing in the Services establishes a professional caregiver relationship or duty of care between you and us.
Emergencies. Echo is not monitored as an emergency or crisis-response service. If there is immediate danger or a situation that requires urgent in-person assistance, contact your local emergency number right away. Use publicly available emergency and community resources in your region.
3. Accounts and security
You may need an account to use certain features. You agree to provide accurate information and keep it updated. You are responsible for safeguarding your credentials and for activity under your account. Notify us at support@aiecho.live if you suspect unauthorized access.
You may sign in using methods we support (such as email and password, Sign in with Apple, or Google). Those providers have their own terms and privacy policies.
4. Subscriptions and payments (Apple)
Paid features or subscriptions, if offered, are billed through Apple In-App Purchase unless we clearly state otherwise in the app.
- Payment processing is handled by Apple. You authorize Apple to charge your chosen payment method according to Apple’s terms.
- Auto-renewal: Subscriptions renew automatically for the same period until you cancel. You can manage or cancel subscriptions in your Apple ID account settings (Settings → Apple ID → Subscriptions on device, or equivalent).
- Price changes: Apple or we may change pricing where permitted; continued use after notice may constitute acceptance as described at purchase.
- Refunds: Refund requests for purchases through Apple are handled by Apple according to Apple’s policies, not by us.
- We may use vendors (for example, RevenueCat) to help manage entitlements and subscription state; their processing is described in our Privacy Policy.
5. Artificial intelligence
Consent before transmission. Personal inputs used for AI generation—such as typed chat, journal or guided journaling text, and voice or audio—are sent to third-party AI processors only after you give in-app consent, as described in Section 5 — Artificial intelligence of our Privacy Policy (including how to turn AI off in Settings).
Parts of Echo use artificial intelligence and machine learning. AI outputs may be inaccurate, incomplete, offensive, or inappropriate. You should not rely on AI responses for legal, financial, or other decisions where tailored professional judgment matters — or for urgent safety situations (use emergency services instead).
When you use AI features, you instruct us to process your inputs (including text and audio you choose to send) with our infrastructure and third-party AI providers as described in the Privacy Policy. If the app offers controls to disable or limit AI features, your use of those controls forms part of your agreement with how the Services operate.
6. Your content and license to us
You retain ownership of content you create and submit (“Your Content”). To operate the Services, you grant us a worldwide, non-exclusive license to host, store, reproduce, process, transmit, display, and create technical copies of Your Content (including backups and security copies), and to sublicense these rights to service providers who assist us (for example, hosting, AI, and moderation), solely to provide, secure, and improve the Services and as described in our Privacy Policy.
You represent that you have the rights needed to grant the above license. You must not upload content you do not have the right to share.
7. Acceptable use
You agree not to:
- Use the Services for any unlawful purpose or in violation of these Terms;
- Harass, threaten, defraud, or harm others, or encourage self-harm or violence;
- Attempt to gain unauthorized access to the Services, other users’ accounts, or our systems;
- Reverse engineer, decompile, or disassemble the app except where applicable law expressly permits;
- Circumvent subscription, usage, or technical limits, or scrape the Services in an abusive way;
- Upload malware or disrupt the integrity or performance of the Services;
- Use the Services to build a competing product using our proprietary materials without permission.
We may remove content or suspend access if we reasonably believe you have violated these Terms or that continued use creates risk.
For concerns about content generated in the app, contact support@aiecho.live.
8. Our intellectual property
Echo, our branding, and the software and materials we provide (excluding Your Content) are owned by us or our licensors. Subject to these Terms, we grant you a personal, revocable, non-exclusive, non-transferable license to install and use the app for your own non-commercial use in accordance with the App Store rules.
9. Third-party services
The Services rely on or link to third parties (including Apple, Google, Supabase, AI providers, and analytics on our website). Their services are governed by their own terms. We are not responsible for third-party services or content.
10. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
Some jurisdictions do not allow certain disclaimers; in those jurisdictions, disclaimers apply only to the extent permitted.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL WE OR OUR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM (EXCLUDING AMOUNTS PAID TO APPLE, WHICH ARE GOVERNED BY APPLE’S TERMS), OR (B) FIFTY U.S. DOLLARS (USD $50), IF YOU HAVE NOT HAD ANY PAYMENT OBLIGATION TO US.
Mandatory consumer protections in your country may not allow certain limitations; in that case, these limits apply only to the extent permitted.
12. Indemnity
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Karuwa Apps Pvt. Ltd. (dba Echo) from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from Your Content, your misuse of the Services, or your violation of these Terms or applicable law.
13. Suspension and termination
You may stop using the Services at any time and may delete your account where the app provides that option. We may suspend or terminate access if we reasonably believe you violated these Terms, pose a security or legal risk, or if we discontinue the Services (where we will try to give reasonable notice when practicable).
Provisions that by their nature should survive (including Sections 2 (disclaimers of professional care), 6 (license as to copies already made where needed), 10–12, 15, and 17) survive termination.
14. Changes to these Terms
We may modify these Terms. We will post the updated Terms and change the “Last updated” date. If changes are material, we may provide additional notice (for example, in-app or by email). Your continued use after the effective date of changes constitutes acceptance unless applicable law requires a different process.
15. Governing law; disputes
These Terms are governed by the laws of the Commonwealth of Pennsylvania, United States, excluding its conflict-of-law rules. If you are a consumer in the EEA or United Kingdom, mandatory consumer protection laws of your country of residence may also apply.
Except where prohibited by applicable law, you agree that exclusive jurisdiction for disputes arising from these Terms or the Services lies in the state and federal courts located in Pennsylvania, and you consent to personal jurisdiction there. You may also have rights to bring claims in the courts of your home country where required by law.
16. Apple App Store
If you obtained Echo through the Apple App Store, the following applies:
- These Terms are between you and Karuwa Apps Pvt. Ltd. (dba Echo), not Apple. Apple is not responsible for the Services or their content.
- Apple has no obligation to furnish maintenance or support for Echo.
- Apple is not responsible for addressing any claims by you or third parties relating to Echo or your use of it, including product liability claims, regulatory failures, or consumer protection claims.
- In the event of failure to conform to any applicable warranty (if any), you may notify Apple and Apple may refund the purchase price paid for Echo to the extent required by Apple’s policies; to the maximum extent permitted by law, Apple has no other warranty obligation.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the provisions in this Section 16 against you.
Apple’s standard end user license for licensed applications is available here: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. If these Terms conflict with required App Store rules, the App Store rules control as to distribution through Apple.
17. General
- Entire agreement: These Terms and the Privacy Policy (and any additional terms we present at purchase) are the entire agreement about the Services.
- Severability: If a provision is unenforceable, the remainder stays in effect.
- No waiver: Failure to enforce a provision is not a waiver.
- Assignment: You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
- Export: You comply with export and sanctions laws applicable to you.
